1. Acceptance of Terms

Welcome to LibRoom! These Terms of Service ("Terms") are a binding legal agreement between you and Nikita Kurnosov ("we," "us," or "our") that governs your use of our mobile application, LibRoom (the "App"), and our companion website, libroom.app (the "Website").

By creating an account, or by accessing or using our App or Website (collectively, the "Service"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

2. Eligibility & Account Registration

To use the Service, you must be at least 13 years old (or 16 if you are a resident of the European Union). If you are between 13 and 18 years old, you may use LibRoom only with your parent's or guardian's permission. By creating an account, you confirm that you meet these requirements.

We do not knowingly collect personal data from children under 13. If you are a parent who believes your child has created an account, please contact us for deletion.

You can register for an account using your email address and a password, or by using "Continue with Google." You are responsible for all activities that occur under your account and for keeping your password confidential. You agree to notify us immediately of any unauthorized use of your account.

3. License & Permitted Uses

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms. You may download and install the App on devices you own or control. You may not copy, reverse-engineer, or redistribute the App.

4. User Content

Our Service allows you to upload, post, and store content, including book details, cover images, reviews, and ratings ("User Content"). You retain all ownership rights to your User Content.

To allow us to operate and improve the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, display, store, reproduce, adapt, and distribute your User Content. This license is granted solely for the purposes of providing, operating, and improving the Service. This license survives termination for backup and archival purposes.

You are solely responsible for the User Content you provide and for ensuring you have the necessary rights to grant us this license.

5. Copyright Notices & Takedown

We respect intellectual property rights and expect our users to do the same. If you are a copyright holder and believe that any content on our Service infringes upon your copyright, please notify us.

To submit a complaint, please email support@libroom.app with the following information:

  1. A description or identification of the copyrighted work you claim has been infringed.
  2. The specific URL(s) or location of the infringing material on our Service.
  3. Proof of your ownership of the copyright or evidence that you are authorized to act on behalf of the owner.
  4. A statement made under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
  5. Your contact information, including your name, address, telephone number, and email address.

Upon receiving a valid complaint, we will take appropriate action, which may include removing or disabling access to the allegedly infringing content and, when appropriate, notifying the user who uploaded it. We have a policy of terminating repeat infringers in appropriate circumstances. Please be aware that you may be held liable for damages if you make material misrepresentations in a copyright complaint.

6. Prohibited Conduct

You agree not to use the Service to:

  • Upload, post, or share any content that is illegal, infringing, harassing, hateful, or otherwise objectionable.
  • Engage in any fraudulent activity, such as phishing, spamming, or distributing malware.
  • Violate any applicable laws or regulations, including copyright law.
  • Circumvent our security features, scrape data, or attempt to gain unauthorized access to our systems or other users' accounts.
  • Make automated bulk requests or scrape book metadata (including ISBN data).
  • Upload personal data of others without consent (doxxing).
  • Interfere with the proper functioning of the Service or endanger the security of our infrastructure or the privacy of our users.

7. Service Availability & Updates

We strive to keep the Service operational but cannot guarantee it will be available at all times. We may need to suspend access for maintenance, repairs, or to introduce new features. We will not be liable for any downtime or interruptions. We may also update the App and Service from time to time, which may add, modify, or remove features. We may remove features; continued use constitutes acceptance. Such updates may be mandatory to continue using the App. For paid LibRoom Pro features, we will give you reasonable advance notice of any material change, and if we materially remove a paid Pro feature, we will offer you a pro-rata refund of the affected portion of your purchase or the right to cancel.

8. LibRoom Pro: Subscriptions and Lifetime Purchases

LibRoom's core features are and will remain free to use. LibRoom Pro is an optional paid upgrade that unlocks additional features. Pro is offered through three purchase options on the Apple App Store (iOS) and Google Play (Android):

  • LibRoom Pro Monthly — an auto-renewable subscription billed every month.
  • LibRoom Pro Yearly — an auto-renewable subscription billed every year. New subscribers receive a 7-day free trial, after which the yearly price is charged automatically unless you cancel at least 24 hours before the trial ends.
  • LibRoom Pro Lifetime — a one-time, non-consumable purchase that grants permanent Pro access on the account that made the purchase.

The current price in your local currency is displayed on the App Store or Google Play listing and on the in-app purchase screen before you confirm the purchase. No charge is applied until you confirm.

a) Payment and Auto-Renewal

Payment for LibRoom Pro is processed exclusively by Apple (for iOS purchases) or Google (for Android purchases); we never see or store your payment-card number, bank account, or billing address. For the auto-renewable Monthly and Yearly plans, your Apple ID or Google account will be charged at confirmation of purchase and again at each renewal, unless auto-renewal is switched off at least 24 hours before the end of the current billing period.

b) Free Trial (Pro Yearly only)

The 7-day free trial is available only for the Pro Yearly plan and only for accounts that have not previously subscribed to LibRoom Pro on the same Apple ID or Google account. If you do not cancel at least 24 hours before the trial ends, your Apple ID or Google account will be charged the yearly price automatically. You can cancel at any time during the trial at no cost by following the cancellation instructions in sub-section (d) below.

c) Lifetime Purchase

LibRoom Pro Lifetime is a one-time, non-consumable purchase. It does not recur and does not expire. “Lifetime” means access for as long as LibRoom Pro continues to be offered, rather than literally forever. It is tied to the individual Apple ID or Google account that made the purchase and, subject to sub-section (f) below, is not refundable once the digital content has been delivered, except where a non-waivable statutory right of withdrawal or refund applies (for example, for EU/UK consumers).

d) Cancellation

You may cancel an auto-renewable subscription at any time:

  • On iOS: open Settings → [your name] → SubscriptionsLibRoom, then tap Cancel Subscription.
  • On Android: open the Google Play Store app → tap your profile icon → Payments & subscriptionsSubscriptionsLibRoom, then tap Cancel subscription.

Cancellation takes effect at the end of the current billing period; you keep Pro access until then. You are not required to give a reason and there is no cancellation fee.

e) Billing Grace Period

If a renewal payment fails, Apple and Google may apply a billing grace period (up to 16 days on iOS) during which Pro access continues while payment is retried. If payment cannot be recovered by the end of the grace period, Pro access ends and your subscription expires.

f) Refunds

Because Apple and Google process your payment, refund requests are handled in the first instance by them under their respective refund policies:

  • App Store purchases: submit a refund request at reportaproblem.apple.com within Apple's published refund window (currently up to 90 days from the date of the charge).
  • Google Play purchases: for an initial purchase, you can request a refund yourself through Google Play's self-service flow, available for the period described in Google's published refund policy. For a renewal charge, or once that self-service window has closed, contact us at support@libroom.app and we will review the request. In every case, any mandatory statutory refund required by the consumer-protection law of your country of residence applies regardless of any platform self-service window (see below).

Beyond the platform refund windows above, we will additionally process refunds where a refund is required by the mandatory consumer-protection law of your country of residence (for example, rights you may have under EU, UK, Russian, or Belarusian consumer-protection law). To request a statutory refund, email us at support@libroom.app.

g) Digital-Content Acknowledgement (EU / UK / similar jurisdictions)

LibRoom Pro is a digital service supplied immediately upon purchase. By starting LibRoom Pro — including by starting a free trial — you expressly request and consent to the immediate performance of the service, and you acknowledge that by doing so you lose any statutory right of withdrawal that would otherwise have applied to a 14-day cooling-off period for digital content and digital services (for example, Article 16(m) of the EU Consumer Rights Directive 2011/83/EU and equivalent provisions in UK, Russian, and Belarusian consumer law). This acknowledgement does not affect the refund routes described in sub-section (f) above.

h) Price Changes

We may change the price of Pro Monthly or Pro Yearly for future billing periods. If we do, we will give you at least 30 days' advance notice by in-app announcement and, where required by the platform, Apple or Google will separately notify you. For material price increases, Apple or Google will ask you to affirmatively consent to the new price before your subscription renews; if you do not agree, your subscription will expire at the end of the current billing period.

i) No Shared Subscription

LibRoom Pro — Monthly, Yearly, or Lifetime — is tied to the individual Apple ID or Google account that made the purchase and may only be used by that account. LibRoom does not participate in Apple Family Sharing or Google Play family library for any of its paid products.

j) Apple App Store Additional Terms

Your licence to use the iOS version of LibRoom is governed by Apple's standard Licensed Application End User License Agreement (“LAEULA”), available at apple.com/legal/internet-services/itunes/dev/stdeula/, except to the extent these Terms modify it. Apple is not a party to these Terms; Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you as an end user.

k) Google Play Additional Terms

Purchases made through Google Play are additionally subject to the Google Play Terms of Service and the Google Play Developer Distribution Agreement as they apply to end users.

9. Intellectual Property Rights

Excluding your User Content, all content, features, and functionality of the Service, including the LibRoom name, logo, and software, are the exclusive property of Nikita Kurnosov and are protected by copyright, trademark, and other intellectual property laws. You may not use our name, logo, or trademarks without our prior written permission. All third-party book covers, titles, and other metadata remain the property of their respective owners.

10. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT WARRANT THE ACCURACY OF BOOK METADATA FETCHED VIA THIRD-PARTY APIS. SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE FOREGOING DISCLAIMERS MAY NOT APPLY TO YOU.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR YOUR PERSONAL INFORMATION; OR (C) ANY BUGS, VIRUSES, OR OTHER HARMFUL CODE THAT MAY BE TRANSMITTED THROUGH THE SERVICE.

OUR TOTAL LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE SERVICE WILL NOT EXCEED (A) USD 100 OR (B) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

12. Indemnity

You agree to defend, indemnify, and hold us harmless from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

13. Termination & Suspension

We may suspend or terminate your account and access to the Service under the following conditions:

  • Breach of Terms: For violating these Terms, such as by uploading illegal content, engaging in prohibited conduct, or scraping the Service.
  • Unlawful Activity: If we suspect you are using the Service for fraudulent or illegal purposes.
  • Security Risk: If your account is compromised or poses a security or privacy risk to us or other users.
  • Non-Payment: If a LibRoom Pro renewal payment cannot be collected by Apple or Google and is not recovered within the applicable billing grace period, your Pro access will end automatically at the close of that grace period.
  • Prolonged Inactivity: If your account has not been accessed for 12 consecutive months. We will send a notice to your registered email 30 days before termination. This inactivity-based deletion does not apply to accounts with an active LibRoom Pro subscription or a LibRoom Pro Lifetime purchase; such paid accounts are excluded from inactivity deletion and will at most be suspended, not deleted, for as long as the entitlement remains active.
  • Legal Requirement: To comply with a request from law enforcement or a court order.

In most cases, we will provide you with 14 days' notice to correct the issue before suspension. For severe violations (e.g., distributing malware), we may disable your account immediately without prior notice. You can appeal a suspension by emailing support@libroom.app within 30 days. Before your account is permanently deleted, you may request a copy of your library data. Requests must be made before the 30-day appeal window ends.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Belarus, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Minsk, Belarus. Nothing in these Terms excludes, restricts, or modifies any mandatory consumer-protection rightgranted to you by the law of your country of residence — including, where applicable, the EU Consumer Rights Directive 2011/83/EU, the United Kingdom Consumer Rights Act 2015, Russia's Law No. 2300-1 “On Protection of Consumer Rights”, and the Republic of Belarus Law “On Protection of Consumer Rights”. Where those laws give you the right to bring a claim in a different forum or to rely on different substantive rules, those laws shall prevail over this Section to the extent of the conflict.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by updating the “Effective Date” and “Last Updated” dates at the top of this page and by publishing an in-app announcement; for changes that affect LibRoom Pro pricing or billing, we will give you at least 30 days' advance notice as described in Section 8(h), and may additionally email the address on your account. Your continued use of the Service after changes take effect constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service and, if applicable, cancel your LibRoom Pro subscription before they take effect.

17. Miscellaneous

Entire Agreement. These Terms (together with the Privacy Policy) are the entire agreement between you and us and supersede any prior agreements.

Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force.

No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations with notice to you.

Force Majeure. We will not be liable for any delay or failure to perform resulting from causes outside our reasonable control, such as acts of God, war, or natural disasters.

Survival. Sections 4 (User Content license), 8(f)–(g) and 8(j) (Refunds, Digital-Content Acknowledgement, Apple LAEULA third-party beneficiary rights), 9-12 (IP, Disclaimers, Liability, Indemnity), 14 (Governing Law), and this Section 17 survive termination.
